TLConline.co.za offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”, “Ts & Cs”), including those additional Ts & Cs and policies referenced herein and/or available by hyperlink. These Ts & Cs apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

1.            Acceptance of Terms and Conditions:

Making a payment signifies your acknowledgment, understanding, and acceptance of our Ts & Cs, and you agree to abide by the Ts & Cs. It is essential to carefully read and comprehend all the Ts & Cs before proceeding with any payment. Failure to agree to these terms restricts your access to our services. Take the time to thoroughly review the terms, and if you have any questions, feel free to inquire.

 

2.            Quotation:

Provided quotes are valid for seven (7) days from the date of issuance.

Discounts are applicable only during the specified period. After this period expires, prices and discounts may be subject to change. Please note that if you have already received and accepted our quote, regardless of whether a deposit has been paid, and your order is already in progress, any special offers, sales, promotions, and discounts offered thereafter do not apply and cannot be adjusted for your order. Only orders placed during the specified period are eligible for special offers, sales, promotions, and discounts.

If the submitted quotation is not fully accepted, we reserve the right to amend the quotation and associated guarantee before commencing the work. Any changes will be presented to the customer for approval and must be signed by the customer before work begins.

We are not liable for any errors or omissions in the quotation. It is crucial to carefully review the quotation and seek clarification before proceeding.

 

3.            Order Changes:

To amend an order, written instructions via email must be provided to us. Changes will be effective only upon confirmation from us via email. Please ensure you receive our email confirmation for any modifications made. 

Although, once the customer approves the layout, we will order the necessary materials. Any subsequent changes requested by the customer to the approved layout may result in additional costs. These additional costs may include but are not limited to material reordering (if the changes to the layout require different materials than those initially ordered); labor costs (adjustments to the layout may necessitate additional labor hours for modifications, installations, or corrections, which could lead to increased expenses); administrative fees (any administrative tasks associated with processing change requests, such as documentation updates or communication with suppliers).

It is important for the customer to carefully review and finalise the layout before approval to minimise the risk of incurring extra costs due to subsequent changes. By proceeding with the ordering process, the customer acknowledges and accepts the possibility of additional charges for layout modifications made after material ordering.

 

4.            Lead Time for Orders and Manufacturing Lead Time:

Lead times for orders may vary based on the number of cabinets and other factors. Specific lead times will be provided during the quotation consultation, usually ranging from 8 to 12 weeks. Custom orders may take 16 weeks. Customers will be kept informed of progress and any delays.

The manufacturing lead time begins upon the official approval of the layout sent via email, not upon deposit payment. Changes to the layout after initial approval may affect lead time.

 

5.            Material Availability and Pricing:

Prices and lead times are determined by the current cost of materials at the time of the quote. If materials become unavailable, alternate options may be proposed, potentially affecting lead time and pricing.

 

6.            Design Layouts and Drawings:

Upon request, 2D top-down layouts will be provided for kitchen orders. 3D drawings are available for an additional fee.

We unequivocally disclaim any liability for measurements that are not undertaken by our team and not explicitly outlined in the design layout plan.

 

7.            Product Design and Size Disclaimer

Actual sizes and designs may vary slightly once the manufacturing process commences. This variation may occur due to factors such as material availability, manufacturing limitations, or improvements in design. In some cases, design changes may be necessary to address potential faults or improve product quality. We reserve the right to make such changes and will inform the customer. However, we assure you that any modifications made will be aimed at enhancing the overall functionality and aesthetics of the product. Our commitment to delivering high-quality products remains unchanged, and any alterations made will be made in the best interest of our customers.

 

8.         Terms of Payment:

8.1       For orders surpassing R10,000.00, a deposit of 70% is mandatory.

Orders valued below R10,000.00 must be settled in full before

the commencement of work. An invoice, inclusive of our banking details for Electronic Funds Transfer (EFT) payment, will be provided.

8.2       Payments conducted through the Point of Sale (POS) system will attract a 3% surcharge for amounts exceeding R3,000.

8.3       All transactions made via our website payment portals will incur a 3% surcharge, irrespective of the payment amount.

8.4       We strongly encourage Electronic Funds Transfer (EFT) payments as our preferred method of transaction.

8.5       We do not accept cash payments under any circumstances. All transactions must be conducted through the approved payment methods outlined in our payment policy.

8.6       The remaining balance indicated on the final invoice is due for payment on the completion date of cabinet manufacturing, and not on the day of delivery, installation, or collection.

8.7       The workmanship guarantee provided by us shall be deemed void if your account remains unpaid in its entirety. To maintain the validity of the guarantee, the account must be settled in its entirety within 30 days from the payment due date.

8.8       Prices are susceptible to change without prior notice. Nevertheless, the quoted price for your order is safeguarded by your deposit, offering a degree of stability in anticipation of potential price adjustments.

8.9       Quoted prices exclude delivery and installation unless explicitly stated otherwise. Additional charges will be applicable for delivery and installation services. We urge you to thoroughly review the quotation for specific inclusions or reach out to us for further clarification.

8.10     Prices quoted do not encompass any appliances, sinks, or taps, except for butler sinks unless explicitly specified otherwise. We recommend reviewing the quotation to ensure clarity regarding the inclusions in your order.

 

9.         Cancellation, Refund and Penalties Policy:

9.1       We will replace defective or damaged items. You are responsible for incorrect orders. Returns or exchanges of non-TLC Online products require undamaged packaging.

9.2       We reserve the right to refuse processing of payment for any order and/or to cancel any purchase, either partially or entirely, with notice provided to you.

9.3.      If payment is made based on a quotation, any cancellation must be communicated via email within two (2) business days.

9.4       As we exclusively manufacture customised, made-to-order products, the following cancellation charges apply:

9.4.1    If the order is cancelled within two (2) days of order placement, quote acceptance, and deposit payment, a cancellation fee of 25% of the order value shall be forfeited from the advance made at the time of order booking. This includes deductions for any consultation fees and a 2.5% transaction fee. Additionally, if materials have been ordered and paid for by us, the cost of materials will also be deducted from the refund.

9.4.2    If cancelled between the 3rd and 7th day, 50% of the order value shall be forfeited.

9.4.3    Orders cannot be cancelled after the 7th day from the date of order placement, quote acceptance, and deposit payment. The Customer

acknowledges that products ordered in terms of this agreement are “special order goods” as set out in sections 17 and 20 of the Consumer Protection Act No. 68 of 2008 (“CPA”).

Please be aware of this policy before finalising your order.

9.5       Refunds for cancelled orders made through our website using PayFast

payments may take 5-10 business days to reflect in the original account used for payment.

9.6       In the unlikely event that we process a refund for a custom, made-to-order project, kindly allow at least seven working days for the transaction to be completed.

 

10.       Collection and Storage:

If you are unable to collect your order on the initially agreed-upon collection date for any reason whatsoever, you may, upon written request, have your cabinets stored at our warehouse.

The cabinets can be stored free of charge for fourteen (14) consecutive days from the completion date or the date the final invoice is supplied, as notified by us.

If you require storage for a period longer than the initial fourteen (14) days, we reserve the right to impose a charge of R100 exc VAT per cabinet, per day, up to a maximum of 3 months, subject to space availability.

Payment for storage is due before the release of the cabinets. This policy is in accordance with the South African Consumer Protection Act and is designed to ensure transparency and fair treatment of our customers.

After the 3-month storage period, if cabinets remain uncollected, we reserve the right to sell them to recover costs. It is important to note that we are not liable for any loss or damage beyond the initial 14-day free storage period.

During the storage period, the customer is responsible for insuring the items, as we cannot take responsibility for any damage that may occur while the items are in storage.

 

11.       Delivery and Site Access:

Prior to delivery, please inspect the delivery route to identify any potential obstacles. Consider the dimensions of doorways, passages, elevators, staircases, and fixtures that could impede the delivery process. Your preparation will help ensure a trouble-free delivery experience.

We kindly request that you provide clear specifications regarding any delivery restrictions we may encounter during the delivery process, such as stairs, apartments, or the need for elevator access. Providing this information in advance helps us plan and ensures a smooth delivery process. This information is crucial for our delivery team to ensure a smooth and efficient delivery to your location. Failure to disclose delivery restrictions, may result in delays or additional charges.

Customers are urged to provide timely and unrestricted access to the site. This is essential for completing the project efficiently and without unnecessary delays. Failure to adhere to this request may result in additional fees and schedule delays.

Delivery charges do not include packaging unless explicitly stated. Additional charges for packaging will apply if required. Packaging costs are calculated at 3% of the total value of the cabinet/s ordered.

For deliveries to complexes or estates, it is your responsibility to adhere to the body corporate regulations regarding truck/delivery vehicle sizes. Our team cannot transport items from the complex/estate entrance to your residence.

Upon delivery, inspect the package immediately for damages. The risk of transporting cabinets passes to the customer upon signing the delivery note. Any faults discovered post-delivery require the customer to bear return shipping costs.

Additional charges may be incurred for deliveries to outlying areas or for the provision of extra hoisting services. Please be aware of potential supplementary costs associated with these circumstances.

Our company policy prohibits us from handling private property. Customers are responsible for moving or securing furniture, fittings, fixtures, vehicles, old kitchens, building rubble, and other belongings to prevent potential damage during delivery. It is requested to clear the site and the path to the site of any potential obstructions. An unobstructed workspace ensures a safer and more efficient process. Failure to adhere to this request may result in additional fees and/or schedule delays.

Prior to scheduled delivery, it is the responsibility of the customer to ensure that the site is adequately prepared. If the delivery team arrives and finds the site unprepared, the cabinets will be offloaded and placed in position to the best of our ability. Subsequently, the customer assumes responsibility for relocating the cabinets to their appropriate locations upon completion of the site. If circumstances render it impossible to offload the cabinets, the delivery will be rescheduled. Any associated transport and storage costs incurred due to rescheduling shall be the responsibility of the customer.

Neither our company nor any of our personnel or subcontractors can be held accountable for any damages resulting from drilling into water supply piping or electrical circuit/wiring located within walls during the installation process.

 

12.       Installation, Self-Installation, DIY:

We do not provide installation services for our loose standing cabinets as they do not require them. Customers are granted the autonomy to install their TLC loose standing cabinet/s independently. The installation process involves the following: upon delivery, our team will position the cabinets according to the customer's specifications. If necessary, the customer must arrange for a plumber to connect the sink cabinet's plumbing, or they may undertake the task themselves. For wall cabinets, installation requires the use of anchor nails, rawl bolts, or plugs and screws, depending on the cabinet's size and weight capacity. 

Self-installations and DIY relieves us of any liability pertaining to incorrect installation or improperly adjusted doors or drawers. The responsibility for these aspects’ rests entirely with the customer. We will conduct a thorough inspection with the customer prior to collection, delivery, or shipping via courier to ensure that all cabinets are built and operating correctly. Any faults found in the factory will be rectified by us before collection, delivery, or shipping via courier. If more convenient for the customer, inspections can be conducted via video call to ensure compliance with quality standards and customer satisfaction.

 

13.       Plumbing and Electrical Services:

We do not provide plumbing or electrical connection services. It is essential that all plumbing and electrical utility points are correctly positioned. If a utility point is in the wrong location, it is the customer's responsibility to have a plumber or electrician relocate it to the correct position, as we will not undertake on-site cutouts or cabinet modifications for improperly placed utility points. 

Additional charges for travel and labour will apply if we are required to return to the site at a later stage due to incorrect utility point placement.

We emphasise the importance of proper preparation and placement to avoid any inconvenience or added expenses. Customers are encouraged to request a layout of their kitchen to confirm the necessary locations for utilities. We are here to assist in ensuring everything is for a successful installation.

 

14.       No Recommendations or Referrals for Contractors:

We are unable to provide recommendations or referrals for contractors offering electrical, turn-key, plumbing, or analogous services.

 

15.       Electrical Point for Cabinet Lights:

Customers are required to arrange and provide an accessible electrical point for cabinet lights installation. This is crucial for ensuring proper functionality during the installation process.

 

16.       Snag list:

The customer must submit a snag list (an itemised checklist of outstanding tasks needing attention) within seven (7) working days from practical completion. Failure to provide a snag list within the specified period will be considered as work completion by us.

Snags will be addressed during regular business hours. If not feasible, any extra costs incurred, such as after hours work or employee transport, will be the customer's responsibility.

These guidelines are essential for a successful delivery process. Your cooperation in adhering to these instructions ensures a seamless experience and helps prevent any unforeseen issues or additional costs. 

These provisions are included to maintain transparency, manage expectations, and address potential changes or challenges that may arise during the project. Your cooperation in communicating any modifications or specific requirements is crucial for a successful and well-coordinated project.

Please be aware that failure to comply with these requests may lead to additional charges and delays in the project schedule. Your attention to these details is essential to ensure a smooth and timely installation process.

The Customer is to take extreme care in completing this list as a second list will not be accepted.

 

17.       Third-Party Supplier Products:

If a third party supplies an item, contact the supplier directly for returns. 

We assume no responsibility for expenses related to third-party agreements, including those with tilers, electricians, and plumbers, arising from prolonged installation periods or delays in installation commencement.

You shall not be entitled to levy any form of penalties against us in connection with delays that may transpire.

The supply and installation of Granite & Reconstituted Granite Products are subcontracted to a third-party supplier. These products necessitate onsite measurements once the carcasses have been installed. The installation of Granite & Reconstituted Granite Products is contingent upon the material's availability, and commencement is anticipated within 7 – 10 working days post-measurement. Confirmation of installation dates will be provided 2 days after the measurement. We retain the right to modify any quotation for Granite & Reconstituted Granite Products based on the final measurement.

 

18.       Material Guarantee, Defects and Warranty:

While we use SABS-approved materials, we cannot guarantee against any future defects or failures, including spills, delamination, flaking, chipping, discoloration, rust, etc. All materials are subject to the respective manufacturer's guarantee/warranty. Please refer to the manufacturer's terms for warranty coverage and conditions.

Additionally, components provided by Blum, including hinges, runners, and Metabox drawer systems, are backed by a lifetime guarantee. It is important to note that the Blum guarantee does not extend to damages caused by granite/stone or building dust resulting from grinding.

The warranty explicitly excludes coverage for water damage, misuse, or overloading of cabinets. The warranty does not extend to products that have been damaged due to improper or abnormal use, mishandling, or modification by the buyer.

The warranty is void if the products are improperly installed or maintained. Normal wear and tear on the surface of the products is not covered under the warranty. The warranty becomes void if cabinets are modified, improperly installed, or damaged before or during self-installation. The warranty does not cover cabinets damaged due to misuse, neglect, abuse, acts of nature, pipe leaks, water damage, exposure to moisture, extreme temperatures, or normal wear and tear.

We recommend the following weight capacity per drawer on our standard drawer runners. If you anticipate larger loads or heavily loaded drawers, please inform us in advance. This will enable us to supply the correct drawer runners to ensure optimal performance and durability. Also note the weight within the drawer needs to be evenly distributed.

19.       Workmanship Guarantee:

All products manufactured by us are covered by a 12-month workmanship guarantee. This guarantee ensures that the products are free from defects in workmanship for a period of 12 months from the date of installation and/or collection. This guarantee is void if the account remains unpaid in its entirety. Settlement within 30 days from the due date is imperative to maintain the validity of the guarantee. In the event of any workmanship-related issues, please contact our customer support for assistance.

 

20.       Drawer Reinstallation Responsibility:

Our drawers are meticulously pre-installed and configured for each individual cabinet. If the customer chooses to remove the drawer for any reason, we shall not be held liable for any damage or issues that may arise from the reinstallation process. The responsibility for the proper handling and reassembly of the drawer lies solely with the customer. Consult with us before removing any drawers.

 

21.       Paint Colour Accuracy:

We cannot guarantee 100% paint colour accuracy, especially for projects completed in multiple phases. Custom colours may not precisely match the provided swatch, as they may appear slightly lighter or darker when applied to different materials. Customers are advised to consider this variation when choosing custom colours.

 

22.       Unfinished Areas:

Cabinets are not painted or finished on the back, bottom, top, and non-exposed sides by default. If you require these areas to be painted or finished, please request costing for this additional service. This ensures clarity regarding the scope of the painting or finishing work and any associated costs.

 

23.       Natural Wood Products Disclaimer:

All-natural wood products are not guaranteed against swelling, warping, cracking, or changes in colour due to local climates or unforeseen circumstances. Customers are advised to be aware of the inherent nature of wood and its response to environmental conditions. Proper care and maintenance are recommended to preserve the quality of the wood products.

 

24.       Butler Sink Cabinets and Tap Hole:

Our butler sink cabinets will come with a standard 32mm hole for taps. Customers should inform us if this size is suitable or if any specific requirements are needed. For precise placement of the tap hole, we require the tap itself to create the necessary cutout in your product. Customers are requested to provide the tap for this purpose, enabling us to accurately position the tap hole.

 

25.       Exclusion of Unforeseen Problems:

The quote does not include any unforeseen or hidden problems that may impact the quoted work. If additional remedial repairs are required during the work, which were not apparent before commencement, a separate quotation will be provided. This notice is designed to ensure clear communication of responsibilities and potential consequences, promoting a collaborative and efficient installation process. Your cooperation is appreciated in adhering to these guidelines.

 

26.       Additional Work or Alterations:

If you request any additional work or alterations beyond the scope specified in the quote, you must inform us via email. We will then provide you with a new quote reflecting the changes.

 

27.       Removal of Pre-existing Cabinets and Materials:

The removal of pre-existing cabinets, materials, rubble, or any other items is not included in the quotation unless expressly stated otherwise. If such removal is required, it will be subject to an additional charge.

 

28.       Customer Indemnification:

You hereby indemnify us and our personnel against all damages, consequential damages, force majeure, unforeseen damages, loss of income, or any other loss incurred by you or any third party due to activities or work performed by us under your quotation.

Restrictions may apply to orders placed using the same customer account, or credit card, or sharing the same billing and/or shipping address. Orders that, in our judgment, appear to be placed by dealers, resellers, or distributors may be limited or prohibited.

If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. It is your responsibility to promptly update your account and other information, including your email address credit card numbers and expiration dates, to facilitate transactions and enable us to contact you as needed.
